The Human Resources (HR) Data Liaison and Compliance specialist coordinates responses to data requests for personnel data to ensure that data are disclosed in compliance with applicable data privacy laws and Department of Human Services policy. Assists HR leadership and legal by coordinating and organizing information necessary for the Department of Human Services General Counsel’s Office (DHS-GCO) to prepare administration staff for depositions and court appearances. Assists HR in preserving and storing information that is subject to litigation hold, and in maintaining administration data in compliance with administration document retention schedules. Coordinates with the DHS GCO to assist in responding to litigation discovery requests. Consults with the DHS GCO requesting advice as needed, to ensure HR’s compliance with applicable laws and DHS policy related to data practices situations. Leads HR function areas to conduct required risk mitigation assessments, create risk mitigation plans and track progress in mitigating identified risks; and tracks and reports divisions’ actions taken to address internal and external audit findings and recommendations.
The incumbent is also responsible in ensuring human resource policies and procedures are up to-date, align with MMB policies where applicable and all HR policies are posted and accessible.
This position has access to labor relations information as defined in M.S. 13.37; participates in meetings where DHS and state labor negotiations proposals are discussed and evaluated; and provides data and information to labor negotiations. The position assists in preparing data for written proposals for presentation at collective bargaining with other members of the HR office.
Responsibilities include, but not limited to: - Serves as the central point of contact between HR and DHS GCO to provide coordination on litigation-related matters, to ensure clear communication and follow through. Ensures preservation and storage of all administration information subject to litigation holds.
- Responds to data practices and labor relations negotiation requests to ensure that public data are supplied in an accurate, complete, and timely manner, ensuring transparency to the public and adequately protecting all data that are not public. Consults with the DHS GCO to compliance with applicable laws related to data practices.
- Track and update HR policies to ensure DHS policies are up to date and align with Minnesota Management and Budget HR/Labor Relations’ policies and are accessible.
- Lead HR to conduct required risk mitigation assessments, create risk mitigation plans and track progress in mitigating identified risks. Track and report actions taken to address internal and external audit findings and recommendations.
Minimum Qualifications To facilitate proper crediting, please ensure that your resume clearly describes your experience in the areas listed and indicates the beginning and ending month and year for each job held. Two (2) years of working with data practices.
Experience must include: - Responding to data requests under the Minnesota Data Practices Act or another law governing data practices/privacy in the public sector.
- Working on complex legal or policy issues in the field of human resources or personnel data practices.
- Knowledge of the following state laws: The Minnesota Government Data Practices Act (M.S. Chapter 13.43) and the Official Records Act (M.S. 15.17).
- Strong research and analysis skills.
- Assisting with responding to discovery requests related to litigation.
- Knowledge of the Administrative Procedures Act (M.S. Chapter 14).
Preferred Qualifications - Variety of experiences working effectively with others from different backgrounds and cultures.
- Experience developing or implementing changes to human services programs and operations.
- Knowledge of applicable state and federal Rules of Civil Procedure pertaining to discovery.
- Understanding of DHS organizational structure, programs, and the interrelationship with Local Agency, federal, and other State agencies.
- Strong human relations and communication skills; ability to communicate clearly and professionally both verbally and in writing; respond openly to requests and concerns.
